FCC: Reaffirms denial of move by 90.5 KACS to Rainier

The FCC again today re-affirmed it’s denial to Chehalis Valley Educational Foundation for a proposed move of Christian 90.5 KACS  Centralia-Chehalis to Rainier WA, including it’s application to increase it’s power from a Class A to Class C3 signal.  The Commission asserts that this move is in violation of a number of rules & policies regarding changing city-of-license changes adjacent to major urban areas.  The FCC stated this would result in a move into the Olympia-Lacey market and thus not a first local service to Rainier under priority rules. CVEF had contended that the relevant principal community contour should be 70 dBu for noncommercial stations, but the Commission said that the 60 dBu contour is proper, leaving KACS covering 53.6% of the Olympia-Lacey-Tumwater urbanized area and 13% of the Seattle urbanized area for purposes of the urbanized area service presumption rule. A previous application for Review of the case was denied, and the licensee tried again with a Petition for Reconsideration, which has been denied as well.
